Kiddicare Canada does not sell products directly through this Website. The Website is intended to provide information regarding Kiddicare products and may contain links directing users to independent third-party retailers, distributors, resellers, and online marketplaces. Any transaction completed through a third-party retailer shall be governed exclusively by the terms, conditions, privacy policies, and business practices of the applicable third party.

Kiddicare Canada is responsible for Personal Information under its custody or control and has implemented policies, procedures, and safeguards designed to comply with Applicable Law.

8. Canada's Anti-Spam Legislation (CASL)

Kiddicare Canada complies with CASL and Applicable Law governing electronic communications.

Commercial Electronic Messages

Kiddicare Canada may transmit Commercial Electronic Messages including newsletters, promotional offers, product updates, educational content, event invitations, survey requests, and marketing communications.

Express Consent

Express Consent may be obtained when an Individual subscribes to a newsletter, completes a lead form, registers through a QR code, requests a product sample, participates in a contest or giveaway, registers for an event, submits a Meta Lead Ad form, or otherwise opts in to receive communications. Express Consent remains valid until withdrawn.

Implied Consent

Where permitted by Applicable Law, Kiddicare Canada may rely on implied Consent arising from an existing business relationship or other circumstances recognized under CASL.

Withdrawal of Consent

An individual may withdraw consent at any time by using the unsubscribe mechanism provided in a communication, following opt-out instructions in SMS or WhatsApp messages, or contacting Kiddicare Canada directly. Withdrawal of Consent shall not affect communications required for legal, regulatory, compliance, security, administrative, or customer-service purposes.

9. Email Marketing

Where Consent has been obtained or another lawful basis exists under Applicable Law, Kiddicare Canada may send emails relating to promotions, new products, product education, parenting resources, newsletters, surveys, events, and brand updates.

All marketing emails will include an unsubscribe mechanism that complies with Applicable Law.

10. SMS and WhatsApp Communications

With appropriate Consent, Kiddicare Canada may communicate with Individuals through SMS, WhatsApp, and other mobile messaging services.

Message frequency may vary. Standard message and data rates may apply according to the Individual's mobile carrier plan.

Individuals may opt out at any time by following the instructions provided in the communication or by contacting Kiddicare Canada directly.

11. QR Code Registrations

Kiddicare Canada may use QR codes during events, retail activations, product sampling campaigns, trade shows, roadshows, and marketing campaigns.

Information collected through QR code registrations may be used to provide requested information, deliver samples, register event participation, send communications where Consent has been obtained, improve Services, and carry out other purposes disclosed at the time of collection.

12. Meta Lead Ads and Social Media Lead Forms

Kiddicare Canada may collect Personal Information through Facebook Lead Ads, Instagram Lead Ads, Meta advertising platforms, TikTok Lead Generation Ads, Google Lead Forms, and other social media platforms.

Information collected may include name, email address, mobile phone number, province of residence, product interests, and marketing preferences.

Personal Information collected through these platforms is subject both to this Privacy Policy and to the privacy policies and terms of the applicable platform provider.

13. Contests, Giveaways and Promotions

Kiddicare Canada may conduct contests, giveaways, sweepstakes, product sampling programs, loyalty programs, referral campaigns, and other promotional activities.

Personal Information collected in connection with these activities may be used to verify eligibility, administer the promotion, contact participants or winners, deliver prizes or samples, communicate with participants, and comply with legal obligations.

Participation in a contest, giveaway, or promotion does not automatically constitute Consent to receive marketing communications unless such Consent is separately requested and provided.

14. Events, Roadshows and Activations

Kiddicare Canada may collect Personal Information at trade shows, retail activations, community events, product demonstrations, roadshows, pop-up events, and brand ambassador programs.

15. Photography, Videography and Event Recordings

Kiddicare Canada may photograph, film, record, livestream, or otherwise capture images, video recordings, audio recordings, interviews, testimonials, and other content during events, trade shows, roadshows, retail activations, community events, contests, giveaways, promotional campaigns, product demonstrations, sampling activities, and other Kiddicare-sponsored or affiliated activities (collectively, "Events").

By attending, participating in, registering for, or otherwise engaging with an Event where notice of photography, filming, recording, or content capture has been provided, attendees acknowledge and agree that their image, likeness, voice, appearance, statements, and other identifying characteristics may be captured, recorded, reproduced, published, displayed, distributed, transmitted, edited, modified, or otherwise used by Kiddicare Canada and its authorized representatives.

Such content may be used for lawful business purposes including, without limitation:

  • marketing and advertising campaigns;

  • social media content;

  • website content;

  • public relations activities;

  • promotional materials;

  • educational materials;

  • corporate communications;

  • event recaps and highlights;

  • brand awareness initiatives; and

  • other commercial purposes related to Kiddicare Canada's business operations.

Attendees waive any right to inspect, approve, or receive compensation for the use of such photographs, recordings, or related content, except where otherwise required by Applicable Law.

Where required by Applicable Law, Kiddicare Canada will obtain additional consent before collecting, using, or disclosing photographs, recordings, or other identifiable content.

 

Individuals who do not wish to be photographed or recorded should notify Kiddicare Canada personnel at the Event or refrain from participating in areas designated for photography or filming.

16. Cookies and Analytics

Kiddicare Canada uses cookies and similar technologies to improve website performance, understand visitor behavior, measure advertising effectiveness, enhance user experience, personalize content, and support analytics and security functions.

Individuals may control cookies through their browser settings. Disabling cookies may affect the functionality of the Website or certain Services.

17. Third-Party Retailers and Marketplace Links

The Website may contain links to third-party retailers, distributors, and online marketplaces where Kiddicare products may be purchased.

Kiddicare Canada does not process purchases, payments, shipping, returns, or exchanges through the Website. When an Individual leaves the Website and visits a third-party retailer or marketplace, the Individual's interactions are governed by the terms, conditions, privacy policies, and business practices of that third party.

18. Disclosure of Personal Information

Kiddicare Canada may disclose Personal Information to service providers, including website hosting providers, marketing platforms, CRM systems, analytics providers, email service providers, SMS providers, event management providers, and other vendors acting on behalf of Kiddicare Canada.

20. Retention of Personal Information

Kiddicare Canada retains Personal Information only for as long as reasonably necessary to fulfill identified business purposes, comply with legal obligations, resolve disputes, demonstrate compliance, protect legitimate business interests, and maintain required records.

Consent and unsubscribe records may be retained for compliance, audit, legal, and regulatory purposes.

Kiddicare products are intended for parents and caregivers. Kiddicare Canada does not knowingly collect Personal Information directly from children without appropriate parental or guardian Consent where required by Applicable Law.
