OFFICIAL TERMS AND CONDITIONS

1. SPONSOR

The Kiddicare Van Tour Canada 2026 (the "Tour") is sponsored, organized, and administered by Zeta Group Ltd. and its affiliates operating under the Kiddicare brand ("Kiddicare", "Sponsor", "we", "our", or "us").

The Tour is designed to introduce Canadian families to Kiddicare products through community engagement, product education, brand experiences, product sampling, promotional activities, giveaways, and other marketing initiatives at participating locations across Canada.

The Sponsor reserves the right, in its sole discretion, to modify, postpone, relocate, suspend, limit, or cancel any Tour stop, event, activation, promotion, contest, giveaway, or activity at any time without prior notice.

Participation in the Tour constitutes acceptance of these Terms and Conditions.

2. TOUR LOCATIONS AND EVENT CHANGES

The Tour may visit participating retail stores, community centres, public venues, private venues, shopping centres, festivals, exhibitions, and other approved locations throughout Canada.

Tour dates, schedules, operating hours, participating retailers, event activities, promotional offers, and giveaway availability are subject to change without notice.

In the event of any discrepancy between information published on social media, advertising materials, printed materials, retailer communications, or any other source, the information published on the official Kiddicare website shall prevail.

The Sponsor shall not be responsible for travel costs, accommodation expenses, or other costs incurred by participants due to event changes, cancellations, delays, or relocation.

 

3. ELIGIBILITY

The Tour is open to legal residents of Canada.

Participation is voluntary and subject to compliance with these Terms.

Certain activities may require:

  • Registration;

  • Completion of a form;

  • Proof of age;

  • Social media participation;

  • Additional waivers or consents;

  • Compliance with activity-specific rules.

Children under the age of majority in their province or territory must be accompanied and supervised by a parent or legal guardian at all times.

Parents and guardians remain fully responsible for the supervision, safety, conduct, and participation of any minors attending the Tour.

The Sponsor reserves the right to verify eligibility and refuse participation where eligibility requirements are not met.

4. TOUR ACTIVITIES

Subject to availability and location-specific restrictions, Tour activities may include:

  • Product demonstrations;

  • Product sampling;

  • Giveaways and prizes;

  • Promotional merchandise;

  • QR code registrations;

  • Photo opportunities;

  • Social media activations;

  • Community engagement activities;

  • Educational product information;

  • Mascot appearances;

  • Retail promotions;

  • Brand ambassador interactions.

Activities may vary by location.

No specific activity, product sample, giveaway, or promotion is guaranteed at every Tour stop.

Participation may be limited due to capacity, safety requirements, inventory levels, weather conditions, venue restrictions, or operational considerations.

5. PRODUCT SAMPLES, GIVEAWAYS AND PROMOTIONAL ITEMS

All samples, gifts, promotional products, photographs, merchandise, toys, stickers, vouchers, and giveaway items are available while supplies last.

The Sponsor reserves the right to:

a) limit quantities distributed per participant or household;

b) require proof of participation;

c) substitute items with products of equal or greater value;

d) discontinue any item or promotion without notice;

e) refuse distribution where fraud, abuse, misconduct, duplication, automated registrations, or suspicious activity is suspected.

All promotional items:

  • Have no cash value;

  • Are non-refundable;

  • Are non-transferable;

  • May not be exchanged for cash;

  • May not be resold.

Lost, stolen, damaged, or misplaced promotional items will not be replaced.

6. CONTESTS, SWEEPSTAKES AND GIVEAWAYS

Certain Tour activities may include contests, draws, sweepstakes, instant-win promotions, or prize giveaways.

Such promotions may be governed by separate official rules.

Where required by applicable Canadian law, winners may be required to correctly answer a time-limited mathematical skill-testing question before being declared a winner.

The Sponsor reserves the right to verify eligibility and disqualify any participant who:

  • Violates these Terms;

  • Provides false information;

  • Uses fraudulent methods;

  • Attempts to manipulate results;

  • Engages in misconduct.

Sponsor decisions regarding contests and giveaways are final and binding.

7. PRODUCT USE DISCLAIMER

Participants acknowledge that Kiddicare products should be used only in accordance with product packaging, instructions, warnings, and recommended usage guidelines.

The Sponsor makes no medical, therapeutic, diagnostic, or health-related claims regarding products distributed during the Tour.

Participants should consult qualified healthcare professionals regarding:

  • Allergies;

  • Skin sensitivities;

  • Medical conditions;

  • Product suitability concerns.

Participants are solely responsible for reviewing product labels, warnings, ingredient information, and instructions before use.

The Sponsor shall not be liable for misuse of any product.

8. PERSONAL INFORMATION AND MARKETING CONSENT

Participants may voluntarily provide personal information through:

  • QR code registrations;

  • Surveys;

  • Promotional forms;

  • Contest entries;

  • Giveaway registrations;

  • Sample requests;

  • Event sign-ups.

By submitting information and selecting applicable consent options, participants agree that Kiddicare may contact them regarding:

  • Products;

  • Promotions;

  • Brand news;

  • Events;

  • Product launches;

  • Special offers;

  • Educational content;

  • Newsletters.

Participants may withdraw consent at any time through the unsubscribe mechanism included in communications.

Submission of personal information does not guarantee receipt of samples, prizes, giveaways, discounts, or promotional items.

9. SOCIAL MEDIA PARTICIPATION AND USER GENERATED CONTENT

Participants may voluntarily submit photographs, videos, reviews, testimonials, social media posts, comments, stories, reels, or other content related to the Tour ("Content").

By creating, submitting, tagging, uploading, or sharing Content associated with Kiddicare, participants grant the Sponsor a perpetual, worldwide, royalty-free, irrevocable, transferable, sublicensable, non-exclusive licence to:

  • Use;

  • Reproduce;

  • Edit;

  • Modify;

  • Publish;

  • Display;

  • Distribute;

  • Translate;

  • Adapt;

  • Create derivative works from;

  • Commercially exploit

such Content in any format, media, or platform now known or later developed.

Participants represent and warrant that:

  • They own or control all necessary rights;

  • The Content is original;

  • The Content complies with applicable laws;

  • The Content complies with platform terms of use;

  • The Content does not infringe third-party rights;

  • Appropriate permissions have been obtained from all persons appearing in the Content, including parental consent where applicable.

The Sponsor reserves the right to remove, reject, edit, moderate, or refuse any Content at its sole discretion.

10. PHOTOGRAPHY, VIDEO RECORDING AND PUBLICITY RELEASE

The Tour may be photographed, recorded, livestreamed, monitored, or otherwise documented by the Sponsor and its representatives.

By attending the Tour, participants consent to the collection and use of their:

  • Image;

  • Voice;

  • Likeness;

  • Appearance;

  • Statements;

  • Photographs;

  • Video recordings.

Such materials may be used for:

  • Social media;

  • Websites;

  • Advertising;

  • Marketing campaigns;

  • Public relations;

  • Retail displays;

  • Promotional materials;

  • Educational materials;

  • Future Kiddicare campaigns.

Participants waive any right to compensation, royalties, inspection, approval, or review of materials.

Parents and legal guardians attending with minors consent to the capture and use of images and recordings of those minors for the purposes described herein.

11. CHILD PARTICIPATION

Parents and guardians acknowledge that certain Tour activities are intended for family participation.

No child may participate in any activity requiring registration, photography, video recording, contest entry, or sample distribution without parental or guardian authorization where required by law.

The Sponsor reserves the right to request parental confirmation or consent at any time.

12. HEALTH, SAFETY AND EVENT OPERATIONS

Participants must comply with:

  • Venue rules;

  • Safety instructions;

  • Staff directions;

  • Retailer policies;

  • Applicable laws.

The Sponsor reserves the right to suspend or terminate participation where necessary for safety, security, operational, or legal reasons.

Participants should immediately report unsafe conditions to event staff.

13. CONDUCT AND RIGHT TO REFUSE PARTICIPATION

The Sponsor reserves the right to refuse participation, deny promotional items, remove participants, or terminate engagement with any individual who:

  • Acts in an unsafe manner;

  • Causes disruption;

  • Uses abusive language;

  • Harasses others;

  • Behaves aggressively;

  • Acts unlawfully;

  • Commits fraud;

  • Damages property;

  • Interferes with event operations.

No refund, compensation, or replacement benefit shall be provided in such circumstances.

14. ASSUMPTION OF RISK

Participation is voluntary and at the participant's own risk.

Participants assume all risks associated with attendance including:

  • Travel-related risks;

  • Weather conditions;

  • Slips, trips, and falls;

  • Crowd-related incidents;

  • Interactions with other attendees;

  • Participation in activities;

  • Interactions with mascots;

  • Use of promotional products;

  • Event equipment and displays.

Participants remain solely responsible for supervising minors in their care.

15. RELEASE OF LIABILITY

To the fullest extent permitted by applicable law, participants release and hold harmless Kiddicare, Zeta Group Ltd., participating retailers, venue owners, affiliates, contractors, agencies, employees, directors, officers, representatives, licensors, successors, and assigns from any claims, liabilities, damages, losses, costs, expenses, or actions arising directly or indirectly from:

  • Participation in the Tour;

  • Attendance at Tour locations;

  • Product sampling;

  • Receipt or use of promotional items;

  • Social media participation;

  • Photography or videography;

  • Contest participation;

  • Event-related activities.

Nothing in these Terms excludes liability that cannot be excluded under applicable Canadian law.

16. RETAILER AND VENUE DISCLAIMER

Participating retailers, shopping centres, venues, landlords, municipalities, and event hosts are not sponsors or administrators of the Tour unless expressly stated.

Retailers and venues are not responsible for Tour operations, giveaways, promotions, or Sponsor decisions.

17. INTELLECTUAL PROPERTY

All Kiddicare names, logos, trademarks, graphics, slogans, designs, promotional materials, and related intellectual property remain the exclusive property of the Sponsor or its licensors.

No participant may reproduce, distribute, exploit, or commercially use any Kiddicare intellectual property without prior written permission.

18. PRIVACY

Personal information collected during the Tour will be collected, used, stored, and disclosed in accordance with applicable Canadian privacy legislation and the Kiddicare

19. SOCIAL MEDIA PLATFORM DISCLAIMER

The Tour is in no way sponsored, endorsed, administered by, or associated with Instagram, Facebook, TikTok, YouTube, X, Pinterest, or any other social media platform.

Participants understand that any information provided is provided to Kiddicare and not to any social media platform.

20. FORCE MAJEURE

The Sponsor shall not be liable for any delay, interruption, modification, suspension, or cancellation of the Tour resulting from circumstances beyond its reasonable control, including but not limited to:

  • Severe weather;

  • Natural disasters;

  • Public health events;

  • Government actions;

  • Venue closures;

  • Labour disputes;

  • Transportation disruptions;

  • Technical failures;

  • Supply chain disruptions;

  • Security concerns.

21. GENERAL CONDITIONS

The Sponsor reserves the right to interpret these Terms and make all decisions concerning the Tour.

All Sponsor decisions are final and binding.

Failure by the Sponsor to enforce any provision shall not constitute a waiver of that provision.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22. GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any dispute arising from or relating to the Tour shall be submitted to the exclusive jurisdiction of the courts located in Ontario, Canada.
